1. Introduction
Welcome to LollaPay, a digital payments platform operated by Lolla Technologies Ltd
LollaPay enables businesses and individuals in Kenya to accept and process payments through QR codes, mobile money, bank integrations, and digital channels.
By accessing or using LollaPay, you agree to these Terms of Service and all applicable laws of the Republic of Kenya.
If you do not agree, you must discontinue use of the platform.
2. Definitions
“Platform” – LollaPay web, mobile applications, APIs, and services
“User” – any individual or entity using LollaPay
“Merchant” – business receiving payments
“Customer” – person making payments
“Services” – payment processing and related services
3. Eligibility
To use LollaPay, you must:
- Be at least 18 years old
- Be legally capable of entering into contracts under Kenyan law
- Provide accurate and verifiable information
- Businesses must be legally registered in Kenya or their respective jurisdictions.
4. Account Registration & Security
You are responsible for:
- Maintaining the confidentiality of your credentials
- All activities conducted under your account
- Immediately reporting unauthorized access
LollaPay shall not be liable for unauthorized use due to user negligence.
5. Services Provided
LollaPay offers:
- QR code-based payments
- Mobile money integrations (M-Pesa)
- Bank payment integrations
- Transaction tracking and reporting
- API integrations for businesses
We may update or discontinue services at any time.
6. Fees & Charges
- Transaction and service fees may apply
- Fees will be disclosed prior to usage
- LollaPay may deduct fees directly from processed payments
- Failure to pay applicable fees may result in suspension.
7. Payment Processing & Third Parties
LollaPay integrates with third-party providers including:
- Banks
- Mobile network operators
- Payment gateways
We are not responsible for:
- Service outages
- Transaction delays
- Failures caused by third parties
8. Compliance with Kenyan Laws
Users must comply with all applicable Kenyan laws, including:
- Data Protection Act, 2019
- Central Bank of Kenya regulations
- Anti-Money Laundering (AML) laws
- Know Your Customer (KYC) requirements
9. KYC & Verification
LollaPay may require:
- National ID / Passport verification
- Business registration documents
- Ongoing transaction monitoring
Accounts may be suspended if verification is incomplete.
10. Acceptable Use
You agree NOT to:
- Engage in fraud or illegal activities
- Process unauthorized payments
- Violate financial or regulatory requirements
- Use the platform for prohibited goods/services
11. Data Protection & Privacy
We process personal data in accordance with:
- Data Protection Act, 2019
We collect data to:
- Facilitate transactions
- Improve services
- Ensure compliance and security
We do not sell personal data.
12. Transaction Responsibility
- Users must verify payment details before confirming
- Transactions may be irreversible once processed
- Disputes should be resolved between the involved parties
13. Security
We implement industry-standard safeguards including:
- Encryption
- Secure infrastructure
- Access control mechanisms
However, users must also maintain security practices.
14. Intellectual Property
All platform content, trademarks, and technology belong to ABNO Cloud or its licensors.
Unauthorized use is strictly prohibited.
15. Service Availability
We aim for high uptime but do not guarantee uninterrupted access.
We are not liable for:
- Downtime
- Maintenance interruptions
- Technical failures
16. Limitation of Liability
To the extent permitted by Kenyan law:
- Indirect or consequential damages
- Loss of profits or revenue
- Third-party service failures
Total liability shall not exceed fees paid in the preceding 3 months.
17. Indemnification
You agree to indemnify LollaPay against:
- Claims arising from misuse of the platform
- Violations of these Terms
- Fraudulent or illegal activities
18. Suspension & Termination
- Terms are violated
- KYC requirements are not met
- Suspicious activity is detected
Users may terminate their account at any time.
19. Governing Law & Jurisdiction
These Terms shall be governed by the laws of:
Republic of Kenya
Disputes shall be subject to the exclusive jurisdiction of Kenyan courts.
20. Changes to Terms
We may update these Terms periodically.
Continued use of the platform constitutes acceptance of the updated Terms.
